Are student loans being garnished in 2024?
Collections (offset and garnishment) on most defaulted loans will stay paused through Sept. 30, 2024, due to the Fresh Start program.
Collection activities are currently paused for all federal student loans through September 2024, which should protect your 2022 and 2023 federal and state tax refunds.
Your loan holder can order your employer to withhold up to 15% of your disposable pay to collect your defaulted debt without taking you to court. This withholding (“garnishment”) continues until your defaulted loan is paid in full or removed from default.
Student loan tax garnishment is when the government takes a portion (or all) of your tax refund to pay off your defaulted federal loans. Tax garnishment is temporarily suspended through September 2024 thanks to the Fresh Start program. Private lenders are generally not able to garnish your tax refund.
To help borrowers successfully return to repayment, we created a temporary on-ramp period through Sept. 30, 2024. This prevents the worst consequences of missed, late, or partial payments, including negative credit reporting for delinquent payments for twelve months.
Will Treasury offset, such as withholding of tax refunds and Social Security benefits, resume after the student loan payment pause ends? No. If you're eligible for the Fresh Start for defaulted loans, any collections on those defaulted loans, including through Treasury offset, will stay paused through Sept. 30, 2024.
The 2024 tax season is in full swing, and while refunds may have started low that isn't the case now. According to comparisons by the IRS, refunds that have already been processed this year are more than 5% higher compared to refunds already sent by March 1, 2023.

- Pay off your debt in full.
Do student loans go away after 7 years? While negative information about your student loans may disappear from your credit reports after seven years, the student loans will remain on your credit reports — and in your life — until you pay them off.
Why are my wages being garnished for student loans?
If you have defaulted on your federal student loans, your loan holder can tell your employer to withhold up to 15% of your wages to collect your student loan debt without taking you to court. This is called an administrative wage garnishment.
Not all debts are subject to a tax refund offset. To determine whether an offset will occur on a debt owed (other than federal tax), contact BFS's TOP call center at 800-304-3107 (800-877-8339 for TTY/TDD help).

What is Refund Advance? Refund Advance is a no-interest loan that is repaid with your tax refund. Apply between Jan. 2, 2024 and Feb. 29, 2024. If approved, a loan will be issued in one of five amounts ($250, $500, $750, $1,250, $3,500).
[1] Note that the full SAVE regulations will go into effect on July 1, 2024, but the Department of Education has implemented three key benefits already: first, the amount of income protected from payments on the SAVE plan has risen to 225% of the Federal poverty guidelines (FPL); next, the Department has stopped ...
Any borrower with ED-held loans that have accumulated time in repayment of at least 20 or 25 years will see automatic forgiveness, even if the loans are not currently on an IDR plan. Borrowers with FFELP loans held by commercial lenders or Perkins loans not held by ED can benefit if they consolidate into Direct Loans.
Through an IDR, loans can be canceled after 10, 20, or 25 years of eligible payments. If you are seeking Public Service Loan Forgiveness (PSLF), these extra periods of payment count toward that program if you meet the other eligibility requirements. PSLF forgiveness can be received after 10 years of eligible payments.
If the loan is paid in full, the default will remain on your credit report for seven years following the final payment date, but your report will reflect a zero balance. If you rehabilitate your loan, the default will be removed from your credit report.
Each plan automatically forgives your remaining debt after 20 to 25 years of payments. Your loans will be written off after 25 years if you borrowed Parent PLUS Loans, federal loans in graduate school, or pay your loans back under the ICR or IBR plan.
The remaining unpaid balance of loans is forgiven after 20 or 25 years. Pay As You Earn (PAYE)—Payments are generally 10% of your discretionary income, but never more than the 10 year Standard repayment plan amount. The remaining unpaid balance of loans is forgiven after 20 years.
enhancements. In filing season 2024, taxpayers will benefit from important updates that reduce the need for many taxpayers to call the IRS and include: Messages with detailed refund status in plain language. Seamless access on mobile devices and with the IRS2Go app.
Will 2024 tax refund be bigger?
After a slow start to the 2024 tax season, the average tax refund this year is now up to $3,070, a 6% increase from this time in 2023. While a $3,000 check in April is a welcome cash infusion, wouldn't it be even better to get $6,000 back? How about $10,000? Or $20,000?
The maximum refundable amount — currently capped at $1,600 per dependent — would increase to $1,800 for 2023 taxes filed in 2024. In tax years 2024 and 2025, the refundable child tax credit amount would grow to $1,900 and $2,000.
If your student loan is in deferment, the IRS won't take your refund. The IRS will only take your refund if you're delinquent with your student loans to offset debt.
Once your federal student loan goes into default, you could face a number of consequences: Your wages can be garnished without a court order. You can lose out on your tax refund or Social Security check, because the money is applied to your defaulted student loan.
When your loan payment is 90 days overdue, it is officially delinquent. That fact is reported to all three major credit bureaus. Your credit rating will take a hit. That means any new applications for credit may be denied or given only at the higher interest rates available to risky borrowers.
